TRENTON, N.J. – The owners and operators of KA Mailers LLC, an Eatontown, N.J., bulk mailing house, admitted defrauding clients by dumping large amounts of mail rather than posting it, U.S. Attorney Paul J. Fishman announced.
Joseph Bisogno, 49, and Kathleen Bisogno, 52, both of Toms River, N.J., pleaded guilty today before U.S. District Judge Peter G. Sheridan in Trenton federal court to Informations charging them with one count each of conspiracy to commit wire fraud.
According to documents filed in this case and statements made in court:
The Bisognos, formerly married, were the owners and operators of KA Mailers, which was contracted by clients to handle large mailings. Clients sent their mail jobs to them for folding, envelope stuffing, labeling, and delivery of mail material to the post office. KA Mailers charged a fee based on the amount of postage necessary to mail the job, as well as a fee for the services it provided in preparing the mail for shipment.
Both defendants admitted that they would not always mail the amount of mail contracted, but instead, would dump the excess mail and create bogus postal forms to make it appear that the mailings had been completed. The fraud began in September 2005 and lasted through March 2011, causing $500,000 in losses for 55 victims, mostly local businesses.
The conspiracy charge to which both pleaded guilty carries a maximum potential penalty of 20 years in prison and a $250,000 fine. Sentencing is currently scheduled for Sept. 14, 2012.
U.S. Attorney Fishman credited inspectors under the direction of U.S. Postal Inspector in Charge Philip R. Bartlett, with the investigation leading to today’s guilty plea.
The government is represented by Assistant U.S. Attorney John E. Clabby of the U.S. Attorney’s Office Criminal Division in Trenton.
